Massachusetts is a "No-fault" divorces state. For most people, divorce will be granted in cases where neither spouse is blamed for the breakdown of the marriage and you simply state in the divorce complaint that an "irretrievable breakdown" of the marriage has occurred. If the parties are in agreement about property and debt division, as well as child custody and child support matters, they can file a "Joint Petition for Divorce" with the Probate and Family Court stating that the marriage is "irretrievably broken," and the divorce can be finalized on an expedited basis without a trial.  While this is the least expensive way to get a divorce you should still have an attorney look over the agreement to ensure that it is in the best interest of you and your children.

In cases where the parties can not agree the divorce proceeding begins when either the husband or wife files a "Complaint for Divorce" with the Probate and Family Court. This sets the divorce in motion.  If there are children involved, both parties will have to attend an approved parent education program .

One of the first questions we get is what kind of support can I expect to pay/receive. Child Support Guidelines are used as a benchmark by the Court in setting support payments. The Court has the power to deviate from these guidelines after a hearing. A form for Child Support Deviation has to include specific reasons for the deviation.

The second question we get is how long does it take to get a divorce. We have provided the Court's guidance on this in the "Time Standards for Cases Filed in the Probate and Family Court Department".

One of the most important documents that you will fill out during the divorce proceeding will be the Financial Statement. Those making under $75,000.00 can fill out the Financial Statement Short Form and those making above $75,000.00 must fill out the Financial Statement Long Form. You should look these over prior to coming into the office so you can discuss the information they require.  In addition, you should start putting together your financial information immediately.
